Recall Terms and conditions

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCEPTING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF THIS RECALL LICENSE AGREEMENT.
1. Purpose of the Recall
1.1. Reason for Recall
Certain controllers may experience a fault due to humidity entering the device, creating safety risks. To address this, Torp d.o.o. is recalling all affected units.
1.2. Scope
This Agreement applies to all end-users who have purchased or otherwise obtained the recalled controllers.
2. Disabling the Old Controller
2.1. Disablement Notification
By providing the requested information to Torp d.o.o., you agree to initiate the disablement of your controller in order to receive a replacement.
2.2. Controller Usage Period Before Disablement
You may use the controller for up to 500 km or 30 days, whichever comes first, from the date you initiate the replacement process. After this period, the controller will be automatically disabled and will no longer function.
2.3. User Responsibilities
Once the recall process is initiated, the affected controller can be used only under the following guidelines:
-Avoid riding in water or rain
-Do not wash the bike with the controller installed
-Always disconnect the main battery connector when the bike is not in use
Any attempt to bypass or reverse the disabling process or to sell the recalled controller is strictly prohibited and will be considered a violation of this Agreement.
Once disabled, the controller must be disposed of according to local electronic waste disposal regulations.
3. Replacement
3.1. Eligibility
You are entitled to receive one (1) replacement controller at no charge if you follow the disabling procedure outlined in this Agreement.
3.2. Shipping and Handling
Torp d.o.o. will cover the cost of shipping of the replacement controller, unless stated otherwise.
3.3. Replacement Controller Options
- 3.3.1. Free Replacement
You are eligible to receive a free replacement controller of the same model once you initiate the replacement process. - 3.3.2. Upgraded controller for an additional fee
During the replacement process, you can opt for an upgraded controller option for an additional fee. In this case, you will be provided with a promo code that you will be able to use at checkout in the Torp Webshop.
4. Liability and Warranty
4.1. Disclaimer of Liability for Continued Use
If you continue to use the recalled controller after the recall process has been initiated, or otherwise disregard this recall, Torp d.o.o. is not liable for any damages, injuries, or losses that result from such use.
4.2. Warranty Conditions
If a recalled controller is replaced with the same model, the replacement will come with a six-month warranty. However, if the original controller has more than six months of warranty remaining, the replacement will inherit that remaining period.
5. Prohibition on Resale or Transfer
5.1. No Resale of Recalled or Disabled Controller
You agree not to open, sell, or transfer the recalled or disabled controller. Once disabled, the controller is permanently non-functional and cannot be resold.
5.2. Consequences of Unauthorized Resale
If Torp d.o.o. discovers that the recalled or disabled controller has been sold or transferred, you will lose your warranty, technical support, and eligibility for future software updates for the replacement controller.
6. Data Privacy
Torp d.o.o. will collect and process personal data as part of this recall in accordance with the EU General Data Protection Regulation (GDPR) and applicable data protection laws. For more information on how your personal data is handled, please refer to our Privacy Policy.
7. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Croatia, without regard to conflict of law principles.
Any disputes related to this Agreement will be resolved in accordance with Croatian law.
