By purchasing, using, or distributing any products from Torp d.o.o., the Buyer agrees to be bound by the terms and conditions of this License Agreement.

INTELLECTUAL PROPERTY OWNERSHIP
All products, designs, specifications, and any related intellectual property covered by this License Agreement are and shall remain the exclusive property of Torp d.o.o. This includes, but is not limited to, all patents, trademarks, copyrights, trade secrets, and any improvements or derivative works thereof, whether developed by the Torp d.o.o. or any third party. The Torp d.o.o. acknowledges that this Agreement grants only a limited, non-transferable license to use the licensed products as defined herein, without any transfer of ownership rights to any of the intellectual property.

 

TORP APP INTEGRATION AND APPLICABLE TERMS
The Torp app is an integral part of the functionality and use of Torp products. By using any Torp product in conjunction with the Torp app, the Buyer acknowledges and agrees that the terms and conditions governing the use of the Torp app are also applicable. These terms include, but are not limited to, privacy policies, usage restrictions, and any software licensing agreements associated with the app. The Buyer further agrees that compliance with the Torp app’s terms is a condition for the proper and continued use of the products.

USE, SAFETY AND LIABILITY
Torp products are power-enhancing components, used on selected brands of electric vehicles. The list of supported brands is regularly updated and published on the website www.torpmotors.com. Use of Torp products in vehicles or in any manner not approved or anticipated by Torp may result in damage to the product or other property and will void the 2-year warranty.

Modifying a stock electric vehicle can result in the vehicle becoming non-compliant with your local road safety regulations. Installing the aftermarket controller and/or motor on the stock electric motorcycle might deviate from the motorcycle manufacturer’s original design and safety standards. Consequently, these modifications can render the motorcycle illegal for road use in your country or state, as it may no longer meet the stringent safety and performance criteria set by your transportation authorities. It’s essential to consult with experts or authorities before modifying your vehicle to ensure adherence to road legality.

Our products are intended solely for use by individuals who are at least 18 years of age.

Keep in mind that Torp d.o.o. is not in any way responsible for any damages or injuries that might occur during the use of their products. Also, Torp d.o.o. is not liable for any legal implications regarding the use of our products on your vehicle.

To enhance user safety, Torp provides general guidelines for the proper usage of products listed in User manuals that can be found on the Torp website. Adhering to these guidelines is crucial for the correct installation and optimal performance of Torp products, as well as for maintaining the validity of the 2-year warranty.

To ensure overall safety and long-term reliability of the product, users must adhere to the following principles:

The user is responsible for the correct installation of the product and the overall condition of the setup. For safety reasons, the user is also responsible for the regular maintenance and inspection of all electrical components on their electric motorcycle.

The user must ensure that the following components are fully functional and appropriate, considering their setup and intended use (power output, type of battery, etc.):
-The circuit breaker or fuse
-Battery Management System (BMS) with overcurrent protection
-Battery wiring harness
-Connectors

In case the controller is not installed in accordance with the installation manuals provided by Torp company, and/or faulty or inadequate components are used in the setup, a short circuit can occur on the bike or controller. This can lead to hazards such as overheating, sparking, fire, and other dangerous situations.

If the controller malfunctions and safety components (fuse, circuit breaker, BMS,…) are not fully functional or properly installed, it can lead to a short circuit with hazardous consequences as mentioned above. Fully functioning safety components will prevent short circuits in case of controller malfunctions.

If the controller has not been consistently used or maintained according to our guidelines, and/or if the 2-year warranty period has expired, it must be disconnected from the power supply during periods of non-use.

Torp products are updated through the Torp App. The updates introduce important performance and safety features. Keeping your device updated is essential for optimal performance. We strongly recommend regularly updating both your Torp App and firmware. Failing to do so may lead to safety risks and could void your 2-year warranty.

To ensure the safe and proper functioning of Torp products, all critical safety updates provided by Torp d.o.o. are mandatory. Failure to install these updates may result in reduced product performance or safety risks. Torp d.o.o. assumes no liability for any damages, malfunctions, or safety issues arising from the user’s failure to install a required safety update.

Even when switched OFF, the controller and peripherals draw a small quiescent current. Over extended storage this can discharge or over-discharge the battery. For any prolonged non-use, disconnect the battery (open the main breaker/kill switch or remove the main connector/fuse). Battery depletion during storage with the battery left connected is a storage-handling issue, not a controller defect.

Installation of Torp products must be carried out by a trained professional, strictly following the guidelines provided in the Torp Installation Manuals and instructional videos. Only the tools and parts supplied with the product must be used during installation. Torp d.o.o. assumes no liability for any damages, injuries, or malfunctions resulting from improper installation, inadequate maintenance, or failure to adhere to the provided instructions.

STORAGE

During any prolonged period of non-use, the controller and peripherals draw a small quiescent current even when switched OFF. To prevent unintended discharge of a connected power source, the controller must be electrically isolated by opening the main breaker/kill switch or removing the main connector/fuse. Any depletion that occurs while the unit is stored with the power source left connected is a storage-handling matter and does not constitute a controller defect.

Store the controller in a dry, clean, dust-free location, protected from condensation, splashes, corrosive atmospheres (e.g., salt mist or chemicals), and direct sunlight. Keep the unit within the specified storage-temperature range stated in this manual, and avoid thermal shock. Do not drop, crush, or place loads on the controller.

Protect all connectors and cable ends from moisture and debris (use protective caps where provided). Do not place the controller on conductive surfaces and keep wiring isolated from metal objects. Store the product on a stable surface away from vibration or mechanical shock. Periodically inspect the controller for visible damage, contamination, or loose connectors before returning it to service.

PRICES AND CURRENCIES
Prices for Torp products displayed are displayed in EUR and USD, depending on the customer`s location.

Prices displayed in EUR are exclusive of VAT. VAT will be added to the final price at checkout, based on the customer’s location and whether the purchase is made on behalf of a company or as an individual customer.

Torp d.o.o. reserves the right to adjust prices listed on the webshop without prior notice.

SHIPPING, DUTIES AND TAXES
Products ordered through the Torp webshop are shipped with DHL. You will be provided with the tracking information as soon as the courier picks up your package.

The customer is responsible for providing accurate shipping information (address, email, and phone number) during the check-out process. Torp d.o.o. can not be responsible for lost parcels or delayed delivery due to false or inaccurate contact information.

Shipments sent via DHL reach their destination within a couple of days, depending on the customer`s location.

The delivery periods we specify here are approximate and may be exceeded due to circumstances beyond our control. Events that are unforeseeable, unavoidable, and beyond our control (so-called «force majeure»), such as war, riots, official measures, natural disasters, delays in transit, labor disputes, strikes, violent clashes, pandemics, or other events, release Torp d.o.o. from the obligation to deliver on time for the duration of these events. Torp d.o.o. is not in any way responsible for any delays in shipping after the package has been collected by the courier company.

Import fees and taxes for orders from the USA, UK, Canada and Switzerland are included in the final price displayed at checkout, and no additional charges will apply.

Customers located in other countries outside the European Union will be required to pay import taxes upon the parcel`s arrival in the destination country. Torp d.o.o. is not responsible for any customs and taxes applied to these orders. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

In case the customer fails to cover the import fees and as a result the package is returned to the shipper, the refunded amount will be deducted by round shipping costs, any related banking fees, and a restocking fee equal to 10% of the product’s price.

WARRANTY POLICY

Torp d.o.o. (“Torp”) warrants that the products listed below will be free from defects in workmanship and materials, under normal use and conditions, for the periods stated, starting from the original invoice date:

  • Torp Controllers and Torp Motors: 24 months (2 years)
  • Wiring harnesses and connectors: 6 months
  • Aluminum bash guards / bash plates / skid plates/protection plates (and included mounting hardware where applicable): 24 months (2 years) against manufacturing defects only (see below)

During the applicable warranty period, and in accordance with these warranty terms and conditions, customers are entitled to free technical support and, at Torp’s discretion, replacement of any product confirmed to be defective.

The warranty does not cover damage to a product:
-Resulting from negligence, improper installation, or improper use.
-Resulting from drops, impact, or any improper handling of the product.
-Resulting from not following installation manuals and installation videos provided by Torp d.o.o.
-Caused by using tools, that are not part of the original product`s packaging.
-Resulting from not using a functional or properly rated fuse or a circuit breaker.
-Resulting from unauthorized dismateling, modification, miswiring, or testing of the product.
-Resulting from using the product in combination with motors, batteries, or other components that are not supported by Torp d.o.o..
-Resulting from using a chain drive instead of the belt (applies to Torp Motors)
-Damage to the product resulting from water ingress—whether caused by not using dielectric grease, power-washing, washing, or submerging the motor while it is hot, or operating the product in activities that involve frequent or prolonged submersion (e.g., riding through streams, rivers, or flooded areas).
-Damage caused by a natural disaster or accidents.
-Theft or loss of the product.
-Exposure to chemicals, extreme weather conditions, or intrusion of foreign objects.
-Any damage to the plastic shield or an aluminum cover.
-Surface scratches that do not affect the functioning of the product.
-Any legal implications regarding the use of our product in the Buyer`s country.
Additional notes for bash guards / skid plates (important)

Bash guards and skid plates are protective wear components designed to be exposed to impacts, abrasion, and cosmetic damage during normal riding. Therefore:

The warranty for bash guards / skid plates does not cover:

-Normal wear and tear, including scratches, scuffs, abrasion marks, dents, or surface finish changes
-Impact or crash damage, including bending, deformation, cracks, gouges, or damage caused by striking rocks, logs, curbs, jumps, or obstacles
-Cosmetic issues that do not affect function (including finish wear, minor colour variation, or anodizing/powder-coat changes over time)
-Damage caused by improper installation, incorrect torque, missing spacers, wrong hardware, misalignment, or installation not following Torp instructions
-Damage caused by use of non-original / incompatible hardware, modifications, drilling, grinding, welding, or any alteration of the plate
-Damage caused by using the plate as a lifting/jacking/tie-down point, or any other use beyond intended protection

If a bash guard / skid plate is confirmed to have a defect in material or workmanship (not impact/wear), Torp will, at its discretion, replace the defective part.

Warranty of pre-release and beta products
Torp d.o.o. provides customers with the opportunity to test products prior to their official release. These products are made available under specific terms and conditions, which are communicated to buyers in advance. Each item is distinctly labeled as “Beta,” “Pre-release,” or “Test” to ensure clarity regarding its status.

Torp d.o.o. provides no warranties, express or implied, for any pre-release products. These products, which may include but are not limited to prototypes, engineering samples, or products provided under limited availability, are offered on an “as-is” basis. The Buyer acknowledges that such pre-release products are still in the development phase, may not have undergone full testing or qualification, and may not function as intended. Pre-release products may contain defects, errors, or bugs, lack necessary regulatory certifications, and may fall short in other areas such as performance and reliability. The Buyer assumes all risks associated with the use of pre-release products.

How to initiate a warranty process:
To initiate the Warranty claim, you must contact the technical support team using the contact form.
It is essential to provide the technical support team with the following information:
-The serial number of the controller (written on the silver sticker on the side of the controller, on the 5th screen of the app, or on the original box).
-Invoice with clearly visible date of purchase (order confirmation and similar documents are not accepted)
-Detailed description of the problem including photos and videos (if applicable).

To ensure we can assist you promptly, please provide all the required information listed above. If any details are missing, our support team may be unable to open your case.

Our technical team will respond to your inquiry as promptly as possible during our office hours (Monday to Friday, 8 AM – 5 PM CET) to assist you with troubleshooting. It is necessary to follow their direction and provide additional information, including photos and videos if needed. If you choose not to follow the guidance provided by our support team, we may be unable to resolve your warranty claim.

In case the problem can not be resolved remotely, our team will provide you with shipping labels and instructions for the return of the product so the inspection can be done in-house.

If the technical team determines that the fault was not caused by the user error and that the item is still under a 2-year warranty, you will be sent a replacement product free of charge. The replacement will come with a six-month warranty, unless the original product still has more than six months of warranty remaining. In that case, the remaining warranty from the original product will be transferred to the replacement.
No monetary compensation can be granted for the faulty products under warranty.

If you return a product for us to inspect and our team confirms that it is functioning as intended, or that the customer`s misuse has caused the fault, you will be responsible for the round-trip shipping costs as well as an inspection fee equivalent to 10% of the product’s price. These fees must be settled prior to the product being returned to you.

Inspection process
Products submitted for inspection may require opening and disassembly to accurately identify the cause of any malfunction. The user acknowledges that this process may involve risks, including potential damage to the product, which could render it unusable. For safety reasons, any product that sustains damage during the inspection process cannot be returned to the user.

EXPIRATION OF WARRANTY COVERAGE
Upon the expiration of the warranty period, free replacements and technical support will no longer be available unless otherwise required by applicable law.
Customers may still access general support resources such as the Help Center and the Facebook community.

TECHNICAL SUPPORT
Torp support team is available from Monday to Friday, from 8AM to 5PM CET. The support team can be contacted via the contact form. Make sure to include all required information to shorten the troubleshooting procedure. Telephone-based technical support is not available.
We have also formed a Facebook community where most of the common questions can be answered.
Complex troubleshooting assistance from our technical team is available for products under warranty. To access this service, customers must provide the invoice and the product’s serial number. If they are unable to provide this information, they can perform troubleshooting themselves using the resources available in our Help Center or by joining our Facebook community.

Technical support is only possible if the user allows data sharing in the Torp App. If data sharing is disabled, we are not able to provide detailed technical support for the device.

RETURNS
All Torp products are thoroughly tested and inspected prior to shipping. The list of parts that should be included in your package is published with every product listing in the Torp webshop. Please make sure to check the package as soon as you receive it. Torp d.o.o. can not be responsible for any missing or broken parts reported after 2 days after the package has been delivered to you.

Any parts ordered from the Torp webshop may be returned (consumer customers only) with the Torp team’s approval within 14 days from the date the order has been delivered. To initiate a return, contact our support team using this contact form.

This 14-day return policy applies only to B2C (consumer) purchases and does not apply to B2B (business) orders.

All returned products must be unused, undamaged, and free from any visible signs of wear, and they must include all original parts in their original packaging. Upon receipt, the Torp team will inspect the returned items. If the product shows any signs of wear or any original parts are missing, only 50% of its original value will be refunded. Additionally, return shipping costs will be deducted from the refund.

If the returned products are found to be unused, undamaged, and show no visible signs of wear, you will receive a refund to your original payment method. The refund will be reduced by the return shipping, any related banking fees, and a restocking fee equal to 10% of the product’s price.

GOVERNING LAW AND JURISDICTION
All disputes, controversies, or claims arising out of or in connection with this Agreement, including any questions regarding its existence, validity, or termination, shall be governed by and construed in accordance with the laws of the Republic of Croatia.

The parties hereby agree that any disputes or claims arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Rijeka, Croatia.
